Medical Insurance children. My husband's ex-wife has physical custody of the children. He is responsible to keep them insured (which we do through my employer - better plan), but he has final say on any medical situations/decisions. Recently, she took both the boys (14yrs & 16 yrs) to the ER for a 99degree fever and stomach bug. We told her she should take them to the physician for a same-day appt. She said twice that Medicaid would cover it. I got the claims back and my insurance doesn't coordinate with Medicaid. The bill is about 3400.00 for an IV and medicine to help their stomach feel better. I want to know if she can be held responsible for this. What would it take to get her to pay for this irresponsible behavior.

A court is likely to disagree with you as an ER is a normal reaction and potential emergencies Trump decision-making. The true legal question is whether your insurance complies with the decree. It's not her fault your insurance won't work with Medicaid. To the extent your husband is liable for the balance he needs to pay it. Usually hospitals will negotiate such bills way down if you seek that.
