Legal Question in Family Law in Georgia

Medical Insurance Coverage After Divorce

I am divorcing my husband. He has medical coverage provided by the company he works for, but is handled through Blue Cross/Blue Shield. My final decree of divorce states that he has to keep me on his insurance. If the judge grants my request, can the insurance company still deny it?

Re: Medical Insurance Coverage After Divorce

The wording of the decree is crucial here. If it says he shall maintain medical insurance and that's all, then he must somehow provide the insurance. If however, it only says that he is to maintain the current insurance and that for some reason becomes impossible, he can't be held in contempt and probably the insurance company can't be forced to carry you. However, if this second is the case, you can file a modification asking the court to order him to maintain the same or similar coverage.
