If a military member shares joint custody but has primary care over the children does that person have the right to sign over rights to another person or does the other parent have the right to gain custody during the deployment?

Of course the parent does not have the right to "sign over right" to someone else! Children are not personal property to be "signed over" at will. See your lawyer to discuss a solution.
