There is no minimum time of separation for FILING for divorce. Getting the divorce is a different matter and, depending on the court, can take a minimum of 30 days after filing.

You must be in a bona fide state of separation when you file (although that could be just a second prior), and must remain separated until the case concludes. Contrary to Mr. Field's incorrect answer, a divorce cannot be granted until at least 31 (not 30) days after filing if both parties so consent (and the time period is longer absent the consent to try).
