Legal Question in Family Law in Georgia

minor name change

My son is 15 yrs. old and wants to change his name to his step-fathers name , he has raised my son since he was 3 , his real father has never really been a part of his life. no child support or anything. my question is can he legally change his last name and does he have to have his fathers permission to do so? If he can how do we go about do it?

A name change will require either the bio-dad's consent, or will be a contested case in which he must be served and could object (then it's up to the court). Step one is to see a lawyer. A compromise I find that often works well is to add a name but not delete the bio-dad's name (so he has four names). That sometimes makes it easier to get a consent. Call me if I can be of help.
