Legal Question in Family Law in Georgia
My Mother, who has Alzheimer disease, has been remarried for less than 10 years to a man with the same disease. They have no mutual assets, each of their properties are held separately. He was committed to a home for Alzheimer patients due to his increasing violent nature and inability to function normally, would not even take a bath. It is my family's desire that she divorce him to avoid future complications surrounding medical payment issues. I have her Durable Power of Attorney; can I file a petition with the Courts here in Georgia for a divorce? He is in another county and she has seen him only one time and will never see him again due to both of them having Alzheimers. Please advise.

The absolute worse thing you can do for her is try to handle these matters without an elder lawyer, or try to do it yourself with an internet website. Any screw ups wiull most likely be discovered after it is too late, and the results could be financially disasterous. Call elder care lawyers in her area today and make an appointment or two.
