Motion for contempt settled before court date

I filed a Motion for Contempt for Non

Payment of Child Support against my ex

spouse. He has paid the majority of the

arrearage and says he will pay the

remainder before the court date. We do

not feel that it is necessary to go to

court at this point. What do I need to

file to dismiss the case or to show we

have reached a resolution and come to

an agreement on our own?

It would be completely foolish to dismiss the case. That sends exactly the wrong message.

If, prior to the court date, he finishes doing what he says, then you can do a dismissal (although that will mean you can't seek other relief, such as attorneys fees and interest, to which you may be entitled).

At minimum, you should consider hiring an attorney (if you do not already have one) to assist you with concluding the matter; however, it is not in your best interest to dismiss prior to payment in full.
