Legal Question in Family Law in Georgia

Motion to Enforce Order by Contempt

What are my options in the State of Georgia to collect full support and the arrears he owes plus interest? How do I get the non-custodial parent to pay full support without going back and forth to court. My child support order from Colorado was domesticated in Superior Court of Clayton County on January 13, 2004. He has 2 Abandonment charges against him in Cobb and Dekalb County. The Solicitors' office have explained there hands are tied when it comes to collecting the arrearages. He $40k in arrears, his support payment is $641 and he only pay $40 per month. I can't afford to hire another attorney. I would like assistance in filing a Motion of Contempt and to Confirm Arrearages and Render Judgment. Are there any legal firms out there that assist the consumer without fully representing them? I need help and fast before he disappears. He has assets too. Thanks for your assistance in advance.

Re: Motion to Enforce Order by Contempt

If legal fees are a problem, a contempt may be the worst option because you pay legal fees, often large, up front.

In a criminal case, the state will focus - usually - on current amounts, so that is unlikely to address arrearages well.

A less-traditional but sometimes excellent option is to hire a collection lawyer or collection agency. Find one that charges no up front fee and will work for a percentage of the recovery. 1/3 is the most you should pay and with a large arrearage you may be able to negotiate 20-25% as a fee. If he has assets a lot of collection lawyers would likely be very interested in the case.
