What if I moved before divorce papers were drafted?

My husband and I married in our home state of Florida. We moved to Georgia and resided there for 7 years. We have a 3-yr-old child who is living with me in Florida after verbally agreeing to separate. Most all of our family still resides in Fl, which is why I moved back. My husband had papers drafted up shortly after my move. Most responses I've read pertaining to moves puts the travel expenses on the one who moved.

I don't feel I should carry the burden of travel expenses for the following reasons:

He initially requested a separation.

I was unable to live separated in Ga for financial reasons and for reasons of child care.

Fl was home to both of us for most of our lives.

Our child has significant family and contacts here.

Husband has a better job.

Am I going to be stuck with half the expenses and forced to follow Ga law? Will he get jurisdiction there or can I request juris. in Fl? I have been in Fl for almost 4 months. Please advise.

The divorce decree will control until and unless it is modified. He will have to file a modification in the county of your residence. If the divorce decree is silent as to the expenses, he will have to pay for those. For more information, consult with a local attorney.
