Legal Question in Family Law in Georgia

moving out of the country

current husband is stationed Guantanamo Bay Cuba he is a Cpt in Army. I stayed here with my 12 yr old daughter because his tour was only 1 year, but it may be extened for 1 more year. We both want to move with him if the tour is extended. My ex husband, her father might not like the idea but she is old enough to choose isn't she? I am primary custodian, she lives with me has since she was born, he gets her every other weekend. He can't keep us from moving can he? I don't want a lot of legal hassles/cost etc. But I don't want to live without my husband either and neither does she.

Re: moving out of the country

It is not your husband that is preventing you from moving it is the court. If you move you are violating a court order. You need to go back to court to get the order modified. For a form to do this own your own go to Fulton County's website. There are many forms there that can guide you through the process. However, if you do not feel that you can do this on your own I our another one of the attorneys that post here would be happy to help you for a fee.
