Legal Question in Family Law in Georgia

ex moving to minnisota- what are my rights?

my ex remarried and has had another child and has informed me she is moving to minnisota with her husband. she has full custody. what are my rights in this situation? can she just take my son away and make me pay to fly him here whenever she sees fit? I can not see where this would be in the best interest of my son to move so far away from his dad. do i have any rights?

You can file to modify visitation. She should bear most of the responsibility for transporation for visitation becuase she is the one moving.

Yep, she can move and take your child with her. You need to immediately consult with a local attorney about filing a modification of visitation since that needs to be filed against her in the county of her residence. If you wait until she moves, it is too late.

You should seek a modification of visitation or petition for a change of custody. You should file this action immediately in order for Georgia to retain jurisdiction over her. If she moves to Minnesota, then you must file the action there. I suggest you consult a local attorney and get started on this immediately.
