Legal Question in Family Law in Georgia

last names

My husband's ex-wife kept his last name and then gave it to her 2nd child, whose father is not in the picture. Can she legally use our last name for a child the doesn't belong to my husband?

If not, what can we do legally to make her change the child's last name and possibly her own?

You can't do anything. It was and is completely up to her whether to keep a married name or not, and any children she has will bear that name.

You should consult with a local attorney. You may be able to establish the child's name as you wish.
