Legal Question in Family Law in Georgia
NCP moving out of state. Want to modify visit to include our twins
My ex-H and I have a 7yo born during marriage and 9 mo old twins born after divorce. He would not legitimize them at birth to make it difficult for me to collect CS. He won't take them every other weekend with the 7yo cause it's not decreed. He's moving to Denver so I want to modify visitation on paper but I don't want to agree to anything that does not include visits for the twins. I beleive it is crucial that our children not be treated so unfairly, the twins wondering why the oldest has a daddy but they don't. I beleive there will be long-term pscholgical effects, resentment, anger, guilt, confusion on everyone's part. The 7yo already feels bad that her sisters don't come to daddy's too but she still goes cause she loves him. I am working with local CS eforcement to get them added to the support order, paternity affidavit has been filed but I need to know how and if I can write up a petition to modify visitiation that takes into account the new enourmous distance as well as her full blood siblings. Paternity is not a question (although I realize I still have to go through the motions since he would not legitamize at birth) as this was a planned pregnancy via IUI. Can I say ''You can't see 1 unless you see all?''

The law is in your favor. However, your situation deserves more of an answer that can be given in this type of format. You should consult with a local attorney to review all of the facts.
