obtaining custody from primary parent

I currently live in another state from my children. My ex-husband has custody during the school year and I during the summer. My ex has been in trouble with the law as well as not having a stable home environment. My children have addressed an intrest in staying with me now, and he refuses to have any lienency. The children are currently with me for the summer and I need to know if I can file here in the state I live, or I have to wait until he has a permanent address. There are 2 children and he has one out of state now. He has no permanent address and a lot of dreams for their future, yet nothing solid. I have a stable home and dreams that reach reality. He is not a bad father yet just not in a position to be transporting them from state to state like luggage.Thank you!!
