parental termination(self prepared)

The other biological party to my two older children is currently in prison for the 2nd time for the same offense, he owes over 10k in child support, only made 2 partial payments, has not had much of anything to do with them,not to mention drug and alcohol addition, and the fact that he comes up for parole at the end of next month..my children have adopted my husband as their father, who has taken on the entire roll of ''daddy '' whom they love dearly. They are only 4 and 5 but are tormented of the possibility of the other ''party'' returning. We are doing everything to ensure our children have everythimg they need, therefore we can't afford an atty. Can you tell/ send me all of the forms I will need in order to terminate his rights, change the names of both children, and allow my husband to adopt the children? please help!

Adoption is FAR more complex than a few forms, and if you have a contested situation, it would be a disaster to attempt it yourself. Adoption is so specialized that only 1-2% of lawyers have done one and know how to do them, and the best answer is for you to save up to do it properly, and not jepordize the children with a pro se adoption, which is likely to fail. If you can get the father to sign, it may be far cheaper than you expect, and even if contested, I suspect you will find the fees worthwhile. My office does handle these cases so please call to discuss it.
