Paternal rights in Georgia

If a biological father hasn't attempted to call or see child, are his rights automatically taken away? I am the mother and I am getting married and my fiance wants to adopt my daughter, how can we go about doing that with the paternal father having nothing to do with the child. He isn't on the birth certificate.

You will need to terminate the biological fahter's parental rights in order to do an adoption. That can be done by either a surrender of the rights by the biological fahter or the rights can be foreceibly terminated. The standard for a termination is to prove that the biological father has had no contanct and not paid any support for 12 months or more.
