Legal Question in Family Law in Georgia

Paternity of kids in question

My husband was divorced 10 years ago. His ex just took another man to court for non paid child support, the man demanded a blood test be done. It turns out the child belongs to his cousin and not him. My husband's ex then informs him that his son may not be his. Can we take her to court to have a paternity test done on his son and daughter? Both of the children look alike and they do not look like my husband. In the divorce it says that he has to pay child support for them. Does he have a right to request a paternity test to find out if he is their biological father or not?

Re: Paternity of kids in question

This is WAY too complicated to answer in this type of forum. He needs to consult with a local attorney knowledgeable in this area. Yes, your husband can take her to court, but, bizarre as it may sound, even if he is proven NOT to be the father, his obligation to pay support may continue, thanks to a fairly recent GA Supreme Court ruling.
