Legal Question in Family Law in Georgia
She won't pay child support
Short history, I have custody of my son. He has lived with me since 1999. Went to court in 1999, received sole custody, papers never signed, my lawyer disbarred. Fast forward to oct 2004. Hired another lawyer have papers filed now stating Mother is to pay 100 dollars in child support a month, 1/2 medical, I still have sole custody.
Son has extraordianary medical. The same amounts were wrote in original order that was never filed. The mother of my child hasn't paid ANY child support in 2 yrs and refuses to work. She sees our son every other sat. supposed to be from 9am-8pm but usually it is for 5 hrs. Is this terms for termination of parental rights? what can I do?

Re: She won't pay child support
I doubt that you could terminate the mother's parental rights based on your facts. You can, however, request that the court hold her in contempt for violating the custody/support decree, which would hopefully motivate her to take responsibility.

Re: She won't pay child support
Except in child abuse cases and adoptions, there is rarely such a thing as termination of parental rights.
What you are actually suggesting is trying to work, as a court will see it, against the interests of your child, as your child has a right to be supported.
While you may or may not succeed at it, what you do have is the right to attempt to collect child support.
