how is two people performing a sexual act infront of a 15 yr old considered child molestation?

Georgia law defines child molestation as: any immoral or indecent act to or in the presence of or with any child under the age of 16 years with the intent to arouse or satisfy the sexual desires of either the child or the person.
In your posting, it may fall under the "in the presence" part of the statute. You really need to consider consulting with someone who is very experienced in handling these type of charges as there is a mandatory minimum 5 year jail term for anyone convicted.
