petition for modification of custody

i was served with a modification of custody and child support by a process server. however the Rule Nisi Order was not signed or gave any dates which to appear in court. the clerk for the superior court did not even sign. can i ask for a dismissal or must i answer?

You should have received either a xerox or conformed copy of the Nisi. However, the fact that your copy is blank does not affect the validity of the petition for modification. Just call the clerk's office and they will tell you the missing info.

Yes, you must answer the petition. The Rule Nisi does not affect the petition at all. I suggest you contact a local attorney for further assistance in the matter.
