Petitioning custody of children

I am in the process of a divorce and getting ready to petition for custody of my 2 children. 2 years ago my soon to be ex-spouse commited a crime of crulety to children in the second degree. She left my daughter who was 3 months old and my stepdaughter who was 3, in the car at walmart when she went inside. She pled first offenders and got 5 years probation. What kind of approach do I need to take and can this be an issue when we go to court?

Your post sounds like you are trying to do this yourself (which is a great way to not get custody as the success rate of pro se cases is rather low). An event a couple years ago may or may not be important, as judges will tend to focus more on recent events. The fact that you asked what you asked instead of what was more central to teh case shows the importance of getting counsel. Yes, the incident probably matters, but that alone isn't going to typically win a case. If your child is important to you, do things right and get good counsel.
