Legal Question in Family Law in Georgia

property settlement in a divorce

My parents deeded their farm to me and they are still living rather than wait for me to inherit it. In a divorce does my husband have a right to the property? We have lived her on the farm for 10 years.

This is a bit tricky. Your argument would be that (1) if you had inherited the property, your husband would have no interest in it and (2) since this was a gift in lieu of inheritance, he likewise has no interest in it. Consult with a local attorney.

Your question will best be dealt with in the context of a personal appoint with an attorney. If you are experiencing marital problems that lead you to suspect divorce may be in your future, your most prudent action will be to speak with an attorney now.
