Legal Question in Family Law in Georgia

protecting my daughter from her bio father

We were married 2 years. We have 1 daughter she is 3 now. When she was 4 weeks old he was arrested on 6 counts of child molestation on my older daughter who was 13 at the time. He was currently on felony prob. for poss. of marijuna & cocaine. The DA didn't want to make my daughter testify and we had no physical evidence. after he spent 8 months in jail the DA plea bargained with him to revoke his probation on the drug charges and drop the molestation charges. he figured he would only serve 6 months so he jumped on it. We wrote letters to the parole board and they denied him early release. He served 3 1/2 years. I divorced him about 4 months after all this started and in the decree he has no visitation. He has a history of domes. violence i had him arrested 2x. He is now out of jail and i am afraid he will try to modify the order. Although he has not tried to pay any child support or make direct contact he has thru mutual aquaintences made statements that he would get his daughter back since he is not a convicted child molester. I am getting married in sept and my fiance wants to adopt my daughter he is the only father she has known. We reside in georgia

Go ahead with the adoption process. Your ex will be given an opportunity to object but you will also be given the opportunity to present the whole case. You should not attempt this by yourself. Consult with a local attorney familiar with this area of the law.

You need to speak with a domestic attorney that handles adoptions. If you do not know of one in your area, I can recommend some to talk to here in Atlanta.
