re-evaluate custody agreement

my husband has full phys. and joint legal custody of our 5 year old step son with the non-custodial parents visitation set at 0-50% at his (the custodial parents) discretion. The child now visits his mother who lives 3hrs away one weekend a month. The divorce agreement was uncontested. The ex was not asked to pay child support based on zero income. She lives in her boyfriends parent's house where there is no bed room or even a private bed for the child. She has never payed the 50% of the child's uninsured medical bills she was ordered to pay in divorce and has never taken the state mandated (GA) parenting class the judge verbally ordered both parents to take. She has continually taken the child into smoke filled environments even after a doctors diagnosis of severe smoke allergies. She has bounced between more than 5 residences and as many jobs in less than two years. How hard woul it be for us to gain full legal as well as physical custody? And how hard would it be for her to get more custody?

Re: re-evaluate custody agreement

Either contact your prior attorney or retain antother. They can file an action with the courts and ask for full physical and legal custody due to the faults of the mother.
