Legal Question in Family Law in Georgia

release/dismiss attorney

How do I release my attorney from my case? I have informed him that I no longer need his services and he was fine with it and has sent me a bill for services to date. I do not want him to file a ''motion to withdraw as counsel'' because I don't want to be charged hundreds of dollars for a motion that I should be able to file myself. If I file a motion to dismiss/release my attorney, do I send it directly to the judge on my case, or do I file it with the court clerk? Thank you.

Re: release/dismiss attorney

Because an attorney can face sanctions from a court and the state bar for not filing a motion to withdraw, even if you file something to dismiss a lawyer a lawyer is likely to file a motion. The Uniform Superior Court rules require him to do so. I have never heard of a lawyer charging for such a motion, so your concern is likely misplaced.

Re: release/dismiss attorney

You can send him a certified letter, cc: to the clerk of court, advising him you no longer need his services. This will make its way to the judge. The attorney will be hard-pressed to charge you further.
