Legal Question in Family Law in Georgia

separating and buying a house

My spouse and I are separating and I would like to purchase some new home. Can my spouse have any legal claim to the house if I am the sole buyer of the house. Or would it be advisable to file for the divorce before buying the house?

Re: separating and buying a house

I advise you to obtain a legal separation or divorce prior to purchasing the new home. If you are separated informally, that is without a court order, your spouse may have a claim to an interest in the new home. We can help you with the separation and/or divorce and the home purchase. Contact me via e-mail or telephone. Thank you!

Re: separating and buying a house

It would definitely be in your best interest to first get a legal separation or divorce before buying the new home. Your failure to do so may result in this property becoming part of the marital estate. Please contact my office immediately to get the action for divorce or separation started so that you can buy an enjoy your new home.
