Legal Question in Family Law in Georgia

Seperated gettinga divorce

My wife and i met in 2004 when i already had my house. She had hers as well. We married in June 2005. In june 2006 she sold her home, we re fied mine (in both our names) and rented it out. We then used about 10k of the profits from her home to purchased a much larger home. A year later she was no longer happy ,(neither was I) She moved out. The larger home got foreclosed on. I moved back into my home. Now she wants her 10k back and 1/2 the interest i paid toward the house i had before i met her. Does she have a right to any of what i stated?

you need to seek counsel asap, this is a battle you must fight and far too complicated to answer in a brief blog.

Re: Seperated gettinga divorce

This is much too complicated to discuss here. This is basically handled by case law dealing with separate v. marital property. Basically, it will be up the judge's interpretation of this case law and the parties presentation of the evidence to prove their point. An attorney can tell you how they will argue the case but the judge will make the final decision. She needs to understand that she may be liable for a portion of the marital debt or shortcomings also.
