Seperation

On May 2, 2004 I asked my husband to leave our home after discovering signs of infidelity. The home is in my name only and was my property before the marriage. He left and has not returned to retrieve his belongings. Unsure of what he is going to do now, after several attempts to communicate a settlement with him, I'm afraid to leave the house for fear he will come in and remove all property. Is it legal for me to change the locks on my doors? I feel like a prisoner in my own home. I do plan to file for divorce. Please advise.

Sure you can change the locks. Just be sure to have your deed (or at least a copy of it) handy. I have had situations like this where the guy will call the cops, claiming to me married to you (which is, of course, true) and that he is a co-owner of the property. You will then be able to prove that you are the sole owner. I would suggest that you go ahead and file for divorce. Talk to your attorney about getting a "Standing Order" or other order which prohibits each party from harassing or molesting the other. You should also get a temporary hearing ASAP, after the divorce is filed, to positively establish your SOLE right to the property.
