Legal Question in Family Law in Georgia
In September of 2005, I moved to GA from FL with my then boyfriend. At that time, I put my house up for sale. In March of 2006, my home sold for a profit and the money was banked in a joint acct with the boyfriend who also had some money set back. In June of 2006, we obtained a joint construction loan and built our home on a piece of property provided by his patents. We married in April. In May of 2007, we went to the bank to close on the house and, to mu surprise, only his name was on the Mtg. In April of 2010, his mother, as part of his inheritance, his mother paid the house note in full. Now after 5 years of marriage, it appears our married life may be over. I do not want him to have to sell "his" home since it is also part of his inheritance , but I don't want to walk away empty handed. What rights would I have in this situation?

See a lawyer immediately. You have made serious and potentially costly mistakes that may or may not be fixable in not using a lawyer all along. When buying a home or selling one, you ALWAYS need a lawyer of your own to review the paperwork (he would have noticed that you were left out and fixed that), and it is even more important when you are unmarried. I cannot tell you if your mistakes are fixable now, but you MUST get a lawyer now. What would have before likely cost a few hundred dollars will likely be far more costly to you now.
