Severing Parental Rights

I have a 12 y.o. child who's father I divorced 7 years ago. I was granted custody and the father was to have visitation rights. It worked ofr less than a year. We have heard nothing from him in over 3 years. I have never received a dime of court ordered child support. I married again and have another child with my husband we have been married since 8/01. We are solid and want to make this one family. How could my husband adopt my 12 year old so that he will not only have the same name but we will have one family on paper as well as in our hearts.

Your husband can file a petition to adopt the child. Notice will have to be given to the father. Most of the time the father does not object where he has in effect abandoned the child for this long. You should consult with local attorney about your options.
