my son just turned 13 and wants to live with me his father . if i try to get custody of him and can't can i try again when he turns 14 ?

As a general rule, when you fail, you will have to wait at least two years to try again, and you will have to show NEW changed circumstances to justody a change of custody. Bear in mind courts do not in most cases ask 13 year olds. Even at 14, while a child can make an election, the judge is not bound by it. However a 14 year old, unlike the 13 year old, gets a voice. Changes of custody are complex and you definitely need to talk to a lawyer.
