Legal Question in Family Law in Georgia

The son will be 14 years old in couple of months and wants to come live with his father. They both have asked the mother several times and she refuses. They have joint custody with her having physical custody. She supposably has a warrant for her arrest in another state. She also has been driving on a suspended license for over a year and do not believe she has a valid driver's license for the state she is living in.

She could at anytime move to another state with the child and tell him they are going to visit and not come back like she did previously. She is living with someone who has let her drive one of his cars (not sure if he gave the car to her or not) and if he didn't would have no transporation or place to live.

She was arrested in late 2009 in the state we believe she would go to for domestic violence battery which was later dropped/abandoned by the prosecutor. It was with her mother and step-father with the child present. We did not know she was in jail until after she got out. She moved here after she got out.

What would the chances of the father getting physical custody of the son?

None, if he doesn't file a case. And very low, unless he gets a lawyer.

With a lawyer, no one can give odds, but he has a better chance than being pro se.
