Legal Question in Family Law in Georgia
My son's father is self-employed and owns his own company. I am in the process of filing for child support. He claims that he pays himself a nominal salary ($300) a week so that they will base his support payments on that amount whereby the company makes probably $145,000 a year. Will they consider the wages from his company as well.

The Court has broad discretion in considering various sources of income for purposes of calculating child support. If it were otherwise, business owners could simply choose to keep the money in their businesses in an effort to hide it from their familial obligations. You are well within your rights to raise this issue with the Court. As always, I would strongly recommend that you retain a Georgia family law attorney when going for child support -- the money you spend on the attorney will be well worth it.

All of his income is considered. To properly present a case involving a child, especially a complex one, you do need counsel.
