Legal Question in Family Law in Georgia
Spouse in Iraq
My husband and I have been separated for over a year. We have one child. I left him due to continued verbal and emotional abuse. He recently accepted a job with KBR in Iraq, and has been there for 2 months. I tried to do an uncontested divorce myself by downloading and mailing him the divorce petition. He called to tell me that he refuses to sign and will not grant me a divorce. He has no intentions of coming back stateside anytime soon. Will Georgia law grant me a divorce without his signature. He's not in military, he's a contractor. I sent a certified copy of the petition and got a return receipt. He told me that he will send the papers back with no signature. Only attaching a note saying that he refused to sign. I am a resident of Georgia and he was a resident of Colorado before moving to Iraq.

Re: Spouse in Iraq
You likely can have him served and do a contested divorce.
You are lucky he did not sign. Paperwork you find online is junk and would very likely have been rejected by the courts. A pro se divorce with a child is nearly impossible, and you need a lawyer.
While it will not be inexpensive, your child is certainly far too important for you to take such risks.
