Legal Question in Family Law in Georgia

In the state of georgia if two people are married but only one party has worked for the year but file income tax together and file for a divorce does this money have to be split equally

Maybe. But if you or your spouse "filed" for divorce then I'm sure you have a lawyer.

Since you're in a divorce, obviously you have a lawyer (and need one). The decision how to divide a refund (and even whether you file together) is made by you and your lawyer, or, in some cases by the judge. If there is a division it may or may not be 50-50.
