Legal Question in Family Law in Georgia

I am stationed at Fort Stewart in Georgia as a medic. I am currently with a girl and will be married in August in Georgia. We have a 10 month old son that was born when she was finishing up her divorce with her previous husband. We know the baby is not his because we did our own at home paternity test. What is the process of getting him off the birth certificate and putting me on it and changing his name to my last name? Or should we wait until we are married to do all the changes and remove the non-biological father from the birth certificate?

The answer depends on what the divorce papers said. If she did them properly, the divorce states the child is not the ex's and is yours. If that is the case, you can likely get a judge, with help from an attorney to order a correction to the birth certificate.

If the divorce names the ex as the father, or is silent, it would be far more difficult (or even impossible).
