Legal Question in Family Law in Georgia

My step dad bought me a HDTV for my birthday,

Now he and my mom split and he says he wants the TV back,

how can i prove it was a gift?

He bought it the same day as my birthday, the tv was always in my room and my mom was with him when he bought it for me.

If he brings the police how can i prove the TV is mine? or would i have to give my gift back?

You don't need to prove it was gift. It is your step-father's burden to prove it WASN'T. If you are still living in your home/apt with your mother, there's no way he gets back in the house to retrieve the TV, unless you or your mother let him in the home. You have possession of the TV, not him. The police will likely not get involved in a domestic situation like this.
