Stepparent adoption/ abandonment

without consent from parent, what are our rights for adoption in the state of ga. based on no visitation with the children since Dec 25.1999 and no child support since february 1999? Our son was diagnosed with cancer May 1999. His father has yet to visit, help with and support, and only calls ocassionally. He refuses to give them up. yet he refuses to be a parent. We are concerned with his stability with the children. please help!

It is possible to involuntarily terminate the paretnal rights of an absent parent if they can be shown to have abondoned the child. Among the factors the court can consider in determining whether the child has been abandoned by the absent parent is whether the child has had no substantial contact with the absent parent for over one year and/or if the absent parent has not provided support for the child for over one year. These factors would not automatically cause a court to conclude that the child was abandonded by the absent parent, but these are among the factual situations which the court may consider in making its determination.
