step-parent adoption when bio-parent is incarcerated

bio-father is incarcerated for felony crime of 40+ counts residential burglary. sentenced to 54 yrs to serve 10. was never married to mother of child, but legitimized her shortly after birth. mother is now married with another child and one on the way. step-father and this child desperately want this adoption to go through. bio-father is trying to fight adoption from prison. charges were filed twice against him for molesting this child. dropped 1st time for ''not enough evidence'' and the 2nd time they were dropped just 1 day after his arrest for burglaries, again with the statement''not enough evidence'', even though there was physical evidence, testimonies from childs pediatrician, 2 seperate child psycologists, a detective where the child resides, defacs caseworker, and 2 childrens hospital social workers. can molestation charges be filed against the bio-father now that the child is older and can testify herself? And what are the chances he could stop this adoption from prison?
