Stepparent adoption
My husband wants to adopt my daughter. I have sole legal and physical custody (my ex had and likely still has a drug problem; he did not even show up to court for our divorce/custody hearing). My ex husband is supposed to pay $120/week in child support, but is about $7,000 behind. He has not seen my daughter in over a year. Also, he had moved from Georgia to North Carolina and then to South Carolina, but I am not even sure what state he resides in now, as he has not made contact with us. We do not have much money for attorney fees. Any advice on where to even begin so that my husband can adopt my daughter would be greatly appreciated! Thank you so much.

Our office handles a significant number of step parent adoptions. To be able to proceed, you either need to find your ex, or show that you have done a dilligent search to locate him (that usually will include but not be limited to an internet search, phoning information, talking to his family, and filing a case with Child Support Recovery or filing an abandonment warrant).
The case will be cheapest if you can locate him and he consents. It will cost more if he cannot be found and most if he is found and contests. Fees vary greatly by county, so I would need to talk to you by phone to get more info (you will find my contact information at www.glenashman.com ).
Best case scenario depending on his consent and your county is usually $850 to $1000 in legal fees, around $80 in court costs, and in some counties about another $250 for a home study (some counties don't do this last step).

Only about 1% of lawyers have ever done an adoption, and far fewer do it regularly, so whomever you hire, make sure the lawyer has significant adoption experience. We have done a few hundred and have practiced at it for 26 years.
