Legal Question in Family Law in Georgia

What steps do I take?

I am needing to know what exact steps do I take in pursuing a divorce. I am wanting to leave the home until everything is final but will that count as abandonment? How would I settle matters as far as getting property out of my name, specifically the house and her car. I'd appreciate any advice.

Re: What steps do I take?

Leaving the home won't count as abandonment as long as your spouse knows where you are and support for the family is taken care of. The rest of your question is too complicated to answer in this type of format. You should consult with a local attorney.

No. Just moving out is not itself abandonment, as long as your whereabouts are not being kept a secret and you are not trying to avoid supporting kids, etc. You didn't indicate whether you had any minor children and whether the divorce is likely to be contested by your wife.

A divorce is commenced by the filing of a rather standard complaint, in most cases. If not contested, they can be fairly quick, relatively painless and inexpensive. If there are issues subject to bitter dispute, however, they could be quite costly and time consuming.

If you live anywhere in the greater Atlanta area, I would likely be willing to represent you. Feel free to call me at (770) 534-1057 for a free initial consultation.
