What are the legalities for subpoenaing phone records for the purpose of discovery?

You just go to the clerk of court where your case is pending, get a subpoena for production of documents, and serve it on the phone company. Be forewarned: the phone company may file a motion to quash the subpoena. Consult a local attorney.
