Legal Question in Family Law in Georgia

During the summer I lost my job, my apartment, and my car so my kids went to stay with their father until i could get back on my feet. At the time he was working,now he is not. He is on parole and probation. And he is selling drugs. I am currently working and I am living back at home with my sister and mother. He keeps telling me I cant get my kids. He is not on birth certificate and no paternity has ever been established. He doesnt and has never paid me child support. My questiomn is Can I get my kids and bring them home with me and he cannot stop me?

Unless he legitimizes the children he has no right to them, and if he refuses to give them to you, he can be charged with either kidnapping or interference with custody.

I would suggest that you see an attorney immediately to discuss the other legal ramifications of the situation.
