Temp. Custody Order
In Jan. my ex husband was awarded temp. custody of my son. We were suppose to go back to court in Feb, but I agreed to let him have custody during a phone conversation with his lawyer. The agreements that we made were suppose to go before a judge and have him either sign it make changes. It is now July and no papers have yet to be filed. How long does that temp. order last? Is there any way for me to get my son back based on this? What can I do to further assist in my case againt him. I cannot afford a lawyer at this time, and need some advice. I now live in SC, but all of this took place in Hall Co. GA.

A temporary order is in place until the final order is done. If you are ready for the final, send the judge's office a letter and let them know that you want to put this on the trial calendar. Also, if you are pro se always make sure that the court knows your current address. If they send you a letter for a court date and you've moved, you could miss court and lose your right to present your case. If both of you do nothing the judge should schedule a hearing at some point in time to clear up the case.
