Terminating Parental Rights in GA???

I have a 5 year old son who is disable and my sons father has not been in the picture almost his entire life. I would like to terminate his parental rights, so that I can change his last name and one day, my husband can adopt my son. Do I have to have the fathers permission or is there a way you can avoid that? He doesnt want anything to do with our son, yet he refuses to sign over his rights.

The adoption IS the procedure whereby parental rights are terminated. The father does not have to agree; however, the father must be served with a copy of the adoption papers. Consult with a local attorney.
