Legal Question in Family Law in Georgia
termination of parental rights
I have a seven year old son, whose father has stopped paying child support and does not exercise his visitation rights nor does he call to check on his son. I have re- married and my husband wants to adopt my son. I was told that my ex- husband would have to go a full year without paying child support and visiting with my child before I could file paperwork to terminate his parental rights. Is this true?

Re: termination of parental rights
While that is generally true, many parents in that situation, to avoid you pursuing support, may sign a consent. If there is a consent, the time periods don't matter.
Re: termination of parental rights
There is no strict time limit for abandonment, but a court will not likely terminate a parent's parental rights without good evidence. However, if your ex-husband wishes to not be a part of his son's life, than maybe he will consent to the termination.
