Legal Question in Family Law in Georgia

I would like a trial separation from my husband but he refuses to move out of the home. The home is in my name only but it was purchased during our marriage with joint funds and has been the marital home for many years. Under these circumstances, do I have to file a Complaint for Separate Maintenance and request a temporary/30 day hearing in order to require that he leave the home?

You can ask in court, but there is no guarantee that you will receive the relief you ask (and in many courts hearings will be much further off than 30 days, or you will have to mediate first). It is possible no one will have to move, or that you may have to move. Since we don't have details you need to discuss these with your lawyer. Discuss this before you even decide what, if anything, to file.
