Legal Question in Family Law in Georgia

I have twins that the father has nothing to do with, and i want to keep it that way. There is no dad listen on the birth cert. but i was married when i had them so they have my ex husbands last name. If i get re married how would my new husband adopt them?

There's no way to fully answer you as to a possible future adoption as it will depend on things that have yet to happen.

However, if you later marry and your future husband wishes to adopt, if the bio-dad has failed to support or see the child, or legitimize the child, it is likely that with a lawyer's help you will be able, at that time, to terminate his rights for purposes of adoption.

Your post adds a complication. I am not clear from your post if your ex-husband is the father. If he is not, hopefully your attorney addressed that in your divorce decree. Otherwise, legally your ex-husband IS the legal father and an adoption will be messier and more complex because both bio-dad AND your ex-husband will be involved. This is a situation where I am hoping you had experienced divorce counsel, as you may have a messier than necessary adoption otherwise.
