Legal Question in Family Law in Georgia

Uncontested Divorce reply

My wife has filed for divorce with an attorney. The divorce requests that i received are unreasonable to me. Do i need to get an attorney or can i send her attorney a certified letter stating what i do not agree to? It is an uncontested divorce and she said that i have 90 days to sign or it automatically goes into effect. Please advise.

Re: Uncontested Divorce reply

You badly need legal counsel right away.

A certified letter has no legal effect (and in fact could harm your case). Never ever directly communicate with opposing counsel. That's disaster.

You do NOT have 90 days. An answer needs to be filed within 30 days of service. The contents of that answer can ruin your case, so do not do this yourself. The answer may also include a counterclaim and other defenses.

If you were served with papers, you are NOT in an uncontested divorce. You are in a contested one.

This sounds fishy to me. In the first place, it doesn't ring true that this is an uncontested divorce if you are served with "questions" (typically known as interrogatories). These are not involved in uncontested divorces. I think they may be trying to sandbag you into taking no action when you should take earlier action. Consult with an attorney ASAP.
