Legal Question in Family Law in Georgia
How does uncontested divorce work? How do you go about starting it?
1 Answer from Attorneys
There are 159 different answers to the question, as each county in Georgia handles them somewhat differently. An uncontested case is any case where both parties agree on everything and cooperate to sign the needed paperwork. Depending on the county and whether you have counsel, you may or may not have hearings. The needed paperwork varies by county and the facts of the case. Children, real estate, joint debts, 401Ks and other things can dramatically affect what paperwork is needed.
There are two ways to start. The one that works well is to hire a lawyer. The one that usuallygenerates problems, slows the case and may not work is to proceed pro se and not have a lawyer.
